Initial Counselling

As a specialist lawyer in family law, I am happy to provide you with initial legal advice on your family matter matter in a first personal meeting at my office in Königstein. For clients who are not from the region, I also offer initial consultations by video call (with Zoom or Teams) or by telephone by prior appointment.

Contents of the initial consultation

During this first meeting, you will receive an initial legal assessment of your personal situation and find out what to expect in the event of a separation or divorce, or what your rights and obligations are towards a family member.

If you are separating from your spouse, you will receive all the necessary information about the course of a divorce proceeding in Germany, the alimony situation, equalisation of gains and pension splitting, the topic of marital home and household goods, custody and access to joint children after separation, as well as options for joint real estate, the tax situation, the right time to separate finances, and the future division of rent, loan instalments, utility costs and insurance payments.

Concrete calculations, such as claims for maintenance and equalisation of gains, and extensive legal research cannot be carried out in this first meeting.

I am also happy to conduct all conversations with you in English.

Duration and remuneration of the initial consultation

An initial consultation usually takes 60 to 90 minutes and costs €226.10 (€190.00 plus VAT).

If you foreseeably need more time during this initial consultation, please point this out to us when making the appointment. In this case, a mandate and fee agreement can be concluded in advance.

Legal advice aid / legal expense insurance

If you are unable to cover the costs of legal advice and representation from your own income and assets, you can file an application for legal advice aid (Beratungshilfe) at the district court (Amtsgericht) of your place of residence. The relevant forms can be found on the website of the Federal Ministry of Justice (Bundesjustizministerium) or the Federal and State Justice Portal (Justizportal des Bundes und der Länder).

On the legal advice aid permit (Beratungshilfeschein) that you need to obtain, all the topics for which you would like legal advice should be entered, such as ‘child maintenance, child support, contact and custody’. Otherwise, the state does not guarantee to cover the full costs of the consultation.

If you have legal expenses insurance, my firm will clarify for you, upon request, the extent to which your insurance will cover the costs of my services.

What should I bring to the initial consultation?

It is advisable to bring the following documents, if available, to the initial consultation or to send them to the office in advance (preferably by email):

    • Your marriage certificate and the birth certificates of your minor children
    • Existing marriage contracts
    • Maintenance titles (youth welfare office certificates, notarial deeds, court orders or settlements)
    • Lawyer’s letters or court orders to which the request for advice refers

    What happens after the initial consultation?

    At the end of the initial consultation, we will either already have determined the specific next steps together (such as a alimony calculation, the submission of the divorce petition, etc.) or you go home with the results of the consultation, sit back and consider how to proceed.
